A new motion was filed in the legal case regarding WWE’s Ludwig Kaiser (real name Marcel Barthel). The defense is preparing for a pre-trial conference, which is set to take place on July 16.
On Tuesday June 16, the defense filed a motion to obtain access to surveillance video from the alleged battery incident Kaiser has been charged with. The defense initially reach out to the apartment complex where the incident took place, but had been told the video could not be released without a subpoena.
The motion, which is unopposed by the state, is requesting from the court to authorize the issuance of a subpoena in order to gain access to the video footage.
The motion states the following:
July 16 is the scheduled date for a pre-trial conference. This will be where the prosecution and defense will attempt to work out whether the case will end in a plea agreement or go to trial. The victim has obtained an attorney who focuses on civil litigation and personal injury.
Kaiser entered a “not guilty” plea in response to the misdemeanor battery charge which he is currently facing. The incident took place back on April 23, 2026 in an apartment complex, in which Kaiser and a female, believed to be his girlfriend were getting aggressively intimate with kissing in the elevator. The alleged victim states that he asked Kaiser and the female to is accused of assaulting a male resident of his apartment complex. The alleged victim says “please have some manners.” After the elevator stopped at the 12th floor, the victim further alleges that Kaiser began punching him and then pushed him to the ground. The report by local police notes they did see a fresh scratch and redness on the victim’s head.
At the present time, Kaiser is free to travel and continue his appearances for AAA.

- Mr. Barthel was arrested and charged with Battery following an incident that occurred at the [Orlando, Florida apartment complex] on or about April 23, 2026.
- The alleged incident took place outside of the elevator on the 12th floor of the apartment complex. Upon information and belief, the event was recorded by video surveillance monitored and stored by [the apartment complex].
- Undersigned counsel contacted the General Manager of [the apartment complex] who indicated that the footage could not be released without a subpoena.
- Mr. Barthel requires a copy of the recording, which should show the alleged incident, to prepare a proper defense.
- Undersigned counsel contacted Assistant State Attorney Shaylynne Kotch who indicated that the State does not object to this motion.
- WHEREFORE, the Defendant respectfully requests the Court enter an Order authorizing issuance of a Subpoena Duces Tecum to [the apartment complex] directing them to produce all related surveillance videos outside of the elevator on the 12th floor of the apartment complex on or about April 23, 2026, at approximately 6:30 p.m.
