Orange County (Florida) court records indicate that this past Tuesday (July 28), the defense representing WWE/AAA star Ludwig Kaiser (real name Marcel Barthel), is scheduled to have a hearing on Monday, October 18 for the motion to dismiss his battery case.

The motion to dismiss, which was filed earlier this month and cites Florida’s “Stand Your Ground” law, claims Barthel’ actions against Richard Reap, the alleged victim were indeed justified. Under the law, a person can use non-deadly force if they reasonably believe it to be necessary for self protection or someone else against “imminent use of unlawful force.”

The first pre-trial conference took place on July 16, with Kaiser’s attorney representing Barthel. The incident, in which Kaiser recounts that Richard Reap swore at him and his girlfriend Andrea Bazarte (and threatening to call ICE on Bazarte), led to a more physical confrontation at the Orlando apartment complex were they both resided.

Kaiser (Barthel) and Bazarte, per Reap were getting aggressively intimate in the elevator. Reap states he asked Barthel and Bazarte to “please have some manners.” However, after the elevator stopped at the 12th floor, Reap further alleges that Barthel began punching him and then pushed him to the ground. The report by local police notes they did see a fresh scratch and redness on the victim’s head.

Kaiser, as El Grande Americano, is scheduled to challenge Dominik Mysterio for the AAA Mega Championship at Triplemania this September.
